Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the website leadfromwithin.ch (the "Site") and the coaching services offered by Nina Costioli, sole proprietor based in Switzerland, operating as Lead From Within (the "Coach", "we", "us"). By accessing the Site or booking any service, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

01About this Site

Lead From Within is a one-to-one and group leadership coaching practice. The Site presents Nina's coaching approach, allows you to learn about services and packages, lets you book a free 30-minute discovery call, and gives signed-in clients a private dashboard for their sessions, notes, homework and resources.

02Eligibility

You must be at least 18 years old to create an account or book coaching services. By using the Site you confirm that you have the legal capacity to enter into a binding contract.

03Your account

• You agree to provide accurate, current and complete information when registering.
• You are responsible for keeping your password confidential and for any activity that occurs under your account.
• You agree to notify us promptly at info@leadfromwithin.ch of any unauthorised use of your account.
• You may delete your account at any time from the account dashboard. We may retain certain data for the periods set out in our Privacy Policy.

04Bookings, rescheduling and cancellations

When you submit a booking through the Site, you are sending a request. The session is confirmed only when Nina accepts it and you receive a confirmation email containing the Google Meet link.

• Rescheduling. You can request a reschedule from your account dashboard up to 24 hours before the session. Nina reviews and approves reschedule requests in good faith subject to her calendar availability.
• Cancellations. Sessions cancelled at least 24 hours in advance can be rescheduled at no additional cost. Cancellations made with less than 24 hours' notice, or no-shows, may count as a used session within your package, unless Nina decides otherwise as a courtesy.
• Force majeure. If illness, technical failure or any circumstance beyond reasonable control prevents either party from attending, we will reschedule without penalty.

05Fees, payment and refunds

Coaching packages are priced as set out in the relevant proposal, invoice or services page at the time of purchase. The discovery call is free of charge.

• Payments are processed outside the Site (e.g. by bank transfer or invoicing) unless explicitly stated otherwise.
• Unless required by mandatory law, fees are non-refundable once a session has taken place.
• If applicable, the Coach is not subject to Swiss VAT (services below the registration threshold) — invoices will state the position clearly.
• Where you contract as a consumer in the EEA, you may have a statutory 14-day right to withdraw from the agreement; this right does not apply once the service has been fully performed with your prior express consent.

06Nature of the services

The services are intended to support reflection, leadership development, and behavioural change. Outcomes depend on many factors, including the actions you choose to take. We do not guarantee any specific result.

07Confidentiality

What is shared during sessions stays confidential. Nina will not disclose any personal information you share, except:

• where you give explicit consent;
• where disclosure is required by law (for example, by court order); or
• where there is an imminent risk of serious harm to you or to a third party.

Anonymised insights — patterns and themes that cannot identify you — may be used for Nina's professional development, supervision, training and teaching.

08Acceptable use

You agree not to:

• Use the Site in a way that breaks any applicable law or regulation;
• Attempt to gain unauthorised access to any part of the Site, account, server, or related infrastructure;
• Probe, scan or test the vulnerability of the Site, or breach any security or authentication measures;
• Send automated traffic, scrape content systematically, or interfere with normal operation;
• Upload viruses, worms, malware, or any other harmful code;
• Reverse engineer, decompile or attempt to extract source code from the Site, except to the extent that mandatory law allows;
• Impersonate any person or misrepresent your affiliation;
• Submit content that is unlawful, defamatory, obscene, hateful, or that infringes someone else's rights.

09Your content

The Site lets you submit content — for example journal entries, homework responses, profile name, and (with your separate consent) testimonials. You retain ownership of what you submit. You grant us a non-exclusive, royalty-free, worldwide licence to use that content strictly for the purpose of operating the Site and providing the services to you.

You are responsible for the lawfulness of what you submit and confirm that you have the right to share it.

10Intellectual property

All content on the Site that is not user-submitted — including text, images, logos, the "5 N's" framework and method, the "Lead From Within" name, design and source code — is owned by or licensed to Nina Costioli and protected by copyright, trademark, and other intellectual-property laws.

You may view and use the Site for personal, non-commercial reference. Any other use — copying, reproducing, republishing, redistributing, sub-licensing or selling — requires our prior written permission.

11Third-party services and links

The Site uses Google Calendar / Google Meet to schedule and host sessions, an SMTP provider to send transactional emails, and CDNs (Google Fonts, jsdelivr) to load fonts and small libraries. The Site may also link to external resources (LinkedIn, podcasts, articles).

We do not control third-party services or sites and do not endorse them. Your interactions with them are governed by their own terms and privacy policies.

12Disclaimers

To the maximum extent permitted by law, the Site and the services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted availability.

We do not warrant that the Site will be free from errors, bugs, or interruptions, or that defects will be corrected.

13Limitation of liability

To the maximum extent permitted by applicable law, Nina Costioli / Lead From Within shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenues, data, business opportunity, or goodwill, arising out of or related to your use of the Site or services.

Our aggregate liability arising out of or relating to the Site or the services is limited to the total amount you have paid us in the twelve (12) months preceding the event giving rise to the claim, or — if you have not paid anything — CHF 100.

Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory law: in particular, liability for death or personal injury caused by negligence, for fraud, or for gross negligence and wilful misconduct under Swiss law.

14Indemnity

You agree to indemnify and hold harmless Nina Costioli / Lead From Within from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to (a) your breach of these Terms or applicable law, (b) your content, or (c) your misuse of the Site.

15Suspension and termination

We may suspend or terminate your access to the Site or to your account, with or without notice, if you breach these Terms, if continued access would expose us or others to legal or security risk, or if we are required to do so by law.

You may stop using the Site at any time. Account-deletion mechanics are described in the Privacy Policy.

16Changes to the Terms

We may update these Terms from time to time. The "Last updated" date at the top of the page shows when changes were made. Material changes will be communicated by email (for account holders) or by a notice on the Site at least 14 days before they take effect. Continued use of the Site after the effective date of the new Terms constitutes acceptance.

17Governing law and disputes

These Terms and any non-contractual obligations arising out of them are governed by the laws of Switzerland, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods.

Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the competent courts of the Canton where Nina is registered, except where mandatory consumer-protection law gives a consumer the right to bring proceedings in their country of residence.

EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr, though we are not obliged to participate in alternative dispute resolution.

18Miscellaneous

• Entire agreement. These Terms (together with the Privacy Policy and any specific package terms) form the entire agreement between you and us regarding your use of the Site.
• Severability. If any provision is held to be invalid or unenforceable, the remaining provisions remain in force.
• No waiver. A failure to enforce a provision is not a waiver of that or any other provision.
• Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a transfer of our business.
• Notices. We send notices to you by email. You may send notices to us at the email below.
• Authoritative version. French and German translations of these Terms are provided for convenience. In case of any inconsistency, the English version prevails.
